Booking Terms & Conditions

  1. These terms apply to all services provided by us, Bali’s Best Babysitting, (“us”, “we” or “Bali’s Best Babysitting”) to you, the customer or client (“you”).
  2. These terms and conditions may not be departed from, released, discharged, supplemented, interpreted, varied or modified in any manner except in writing signed by an owner of Bali’s Best Babysitting.
  3. These terms and conditions will prevail over any terms and conditions used by you or contained or set out or referred to in any documents sent by you to us. By confirming a booking with us, you agree irrevocably to these terms and conditions.

Our Services

  1. If we provide a nanny to you, you agree to accept these terms and conditions and to pay our fees as set out at our web site and on your booking confirmation.
  2. If you engage a nanny through us, then you agree to pay our charges as provided in our quote or booking confirmation.
  3. You must not contact any nanny provided by us to engage them directly without discussing the booking with us first.
  4. We reserve the right to substitute a nanny for one previously agreed with you if the first nanny is unavailable for reasons beyond our control.

Pricing and Payment

  1. Hourly rates are published on this web site on the Booking FAQ’s page.
  2. These costs are for the care of 2 / 3 children only per nanny, depending on what you have booked.
  3. We charge in blocks of 1 hour only and will round up to one hour at all times.
  4. We will provide all quotes and costs in Australian Dollars.
  5. The cost of your booking will be the relevant hourly rate over the time of your booking plus any applicable transport costs.
  6. Before accepting and confirming a booking, we will need to be paid a deposit towards the total fees payable by you for our services. This deposit will be $1.50 – $2.00 per hour for each hour of the booking + transfer costs (if chosen).
  7. The total deposit calculated in the PayPal invoice is valid for 2 days from the date of issue.
  8. Your booking is not confirmed until payment of your deposit is finalised.
  9. The balance of the payment will be due while in Bali and payable directly to your nanny.
  10. Payments can only be made by Paypal.  You do not need a Paypal account to make this payment, you can make payment by credit card if you need to.
  11. If you believe the nanny has breached the terms of the agreement after payment, you will be responsible for recovering any fees from the nanny, as we will not accept this responsibility.

Amendments to existing bookings

  1. Bali’s Best Babysitting is happy to process any amendments to a booking without charge.

Booking Cancellation

  1. The deposit for your booking is non-refundable as we are unable to offer the nanny other work while we have your booking in our calendar.
  2. The only exception to this policy is if your nanny is sick or needs to care for one of their family.  We will then refund the remaining deposit hours.
  3. Under extenuating circumstances and at the discretion of Bali’s Best Babysitting, we may offer you a credit for the deposit of your booking.
  4. If, prior to your departure, we are unable to provide the nanny you have requested due to circumstances beyond our control, for instance if the nanny cancels the engagement, then we will endeavour to find an alternative nanny for you. If we are unable to provide an alternative nanny then we will reimburse the deposit payment paid by you.
  5. Cancellation of less than 48 hours will require the Total Balance of your booking to paid via additional invoice.
  6. In the event of natural disaster, illness or inability to fly, you are welcome to claim your Deposit plus Total Balance on your travel insurance and we will support you through this process.

Nanny Working hours

  1. Working hours can range from 7am (at the earliest) until 2am (at the latest).
  2. A nanny will work for a minimum time period of 4 hours in each booking session. If she is required to work less than this time period, payment will be for the full 4 hours.
  3. A nanny will work for a maximum of 12 hours in each booking session.

Live in Nannies

  1. Live in nannies will incur an additional overnight cost -$35 per night.
  2. Live in nannies must be provided with all meals and refreshments at your cost.
  3. Live-in nannies must be provided with adequate sleeping arrangements that include a private room and bed. The nanny may share the room with the children.

Nature of Our Services

  1. We are a booking agent and the nannies are independent contractors and no employment relationship shall be created by any provision of services by us.
  2. You are responsible for providing us with accurate information about your requirements before you engage a nanny.
  3. One nanny can look after a maximum of 2 children at any one time. This condition can be varied where one of the children is aged 6 – 12 years or older.
  4. Any nanny provided to you will be a self-employed contractor who will provide nanny services to you during your holiday.
  5. The nanny has the right to refuse any booking she feels is inappropriate because of misinformation (e.g number of children) or safety concerns.
  6. If you have any concerns, we encourage you to raise them with us during the booking rather than after the booking is completed. It may not always be possible to address the issue after the booking is completed.

Our Liability

  1. Bali’s Best Babysitting only act as a booking agent for the independent contractors – “The Nannies or The Nanny”. We will not be held liable to you for any expense, indirect, special or consequential loss you may suffer arising out of or in connection with the provision of any services pursuant to these terms whether arising in contract or otherwise in law or equity as a result of the rendering of these services. This includes any delay(s), substitution(s), rescheduling(s), or change(s) in the provision of services arranged by Bali’s Best Babysitting or by reason military action, revolution or “acts of God”, or by any subcontractors or third parties whatsoever supplying any of the services. Indirect, special or inconsequential loss means losses such as loss of profit, lost opportunity or lost reputation.
  2. We agree to ensure each nanny has participated in First Aid & CPR training at a reputable training centre in Bali.
  3. We will also check 2 references supplied by the nanny. Where a nanny has relevant professional or other qualifications, we will seek to obtain copies of the relevant certificates.
  4. You agree that provided we take these steps we are not obliged to carry out any further background checks on nannies introduced to you.
  5. We cannot guarantee the suitability of any nanny supplied to you and we will not be liable for the acts or omissions of the nanny, who will be directly engaged by you, you are therefore advised to make sure you are satisfied with the nanny and inform us if this is not the case.
  6. If you require the nanny to take your children swimming, as a term and condition of your booking, we require you to supervise and assist in this activity at all times.
  7. As part of your booking terms & conditions, we insist that you must purchase sufficient travel insurance to cover loss, illness, injury and death.
  8. As the nanny is an independent contractor who will be directly engaged by you and we are the booking agent, we will not be held responsible for loss, liability, death or personal injury arising as a result of mishap or negligence by the  independent contractor.

General

  1. Any proceedings arising out of or in connection with this agreement must be brought directly with the independent contractor.
  2. Failure by us at any time to enforce any one or more of the terms and conditions set out above will not prevent us from taking steps to enforce at a later date any right we may have under these terms.
  3. The nannies are independent contractors and no employment relationship shall be created by any provision of services by us.
  4. We will be entitled to subcontract any of our rights or duties under these terms.
